The Coming Change

On Wednesday this week at a quiet ceremony in Chantilly’s Resort, Minister Rialuth Serge Vohor presented six organisations with telecommunications operator licenses. His action marked the beginning of a new chapter in Vanuatu’s integration into the wider technological world.

The Minister’s speech touched on many aspects of the technical and social challenge ahead of us, but its illuminating principle was his lifelong conviction that Vanuatu should control its own destiny. Acknowledging and applauding the invaluable assistance provided by numerous donor and commercial partners from overseas, he nonetheless displayed great satisfaction at seeing local operations moving into the spotlight.

There was an air of quiet excitement in the room as, after patient months of waiting, representatives from the six groups, along with Digicel Vanuatu CEO Tanya Menzies, strode to the front of the room to accept the newly signed documents.

At the risk of sounding like a giddy shoolchild, I wonder if everyone realises just how fundamentally this moment is going to affect our generation and the next.

Open Season

[This week’s Communications column for the Vanuatu Independent.]

With the recent passage of a new telecommunications Act (awkwardly titled the TELECOMMUNICATIONS AND RADIOCOMMUNICATION REGULATION ACT), Vanuatu has taken another important step in ensuring continued success in building openness and fairness into the business of communications.

Parts of the Act, currently awaiting the President’s signature, validate and give force of law to terms and conditions already included in the licenses issued to our two incumbent telcos. It also provides an overall framework for continued growth, expansion and innovation. Most importantly, it makes permanent the office of the Telecommunications Regulator.

(Before I go on, I should make it clear that the text of the Bill was under discussion until shortly before it was voted on. The version I was able to view was not the official text. That will only become available once the Clerk of Parliament receives the signed Act from the President. That said, I’m pretty confident that those parts of the Act discussed here are unchanged.)

Perhaps the most notable aspect of this new legislation is the delegation of the right to issue telecoms licenses to the Regulator. Until the Act takes effect, this power is retained by the Minister.

John Crook, the Interim Telecommunications Regulator, has made it clear that he wants to see the process of obtaining what’s termed a Telecommunications Operator License to be as simple and direct as possible. All that should be required to start a new Internet Service Provider is to demonstrate that you have the right to operate such a business in Vanuatu, that you have the means to do so and that you’re willing to play by the rules.

Gift Economy – Ctd.

Last week’s column on the relationship between chiefs, politicians and public servants provoked a good deal of discussion at the nakamal over the course of the week. Nobody contested the idea that we need to stop treating core government services as gifts to be doled out to political supporters. But there was some divergence of opinion regarding what changes, if any, were required.

Perhaps most interesting of all, nobody questioned the involvement of cabinet ministers in ensuring service delivery. The question was not whether the Minister should get involved in service delivery, but how he should do so.

Students of government from overseas might find themselves squirming at the very thought of such a question. The strong separation of politics and administration is one of the basic principles of the Westminster tradition. Many – if not most – of the major scandals in Vanuatu politics since Independence have been the result of the politicisation of roles and responsibilities in public service delivery.

Gift Economy

The chief sat down, massaged his swollen hand in its cast and regaled me with the story of how he got the road cleaned up.

Numerous neighbourhoods in Port Vila are notorious for the condition of their roads. Some become impassably muddy, some become lakes when it rains, some are worn down to rocky tracks suitable only for goats. In a few cases, the road should never have been constructed where it was. In others, years of neglect have worn away what little engineering might have gone into them in the first place.

This chief was not the first – and will certainly not be the last – individual to wage a personal campaign to see conditions improved in his neighbourhood. His approach was typical, too. He worked his way through a network of brokers, often smoothing the conversation with kava, cigarettes and other blandishments, until he finally got the ear of the Minister. A brief, impassioned appeal to the big man, accompanied by a review of voter numbers and allegiance, was greeted in the end by the assurance that something would be done.

Sure enough, within a few days, the Minister is striding through the department offices, commandeering trucks, equipment and men to the site in question and ordering them to clean things up right quick.

The chief was rightly proud of what he’d achieved on behalf of his community. I must say I admire him, too, for his patience and commitment. Others would have given up or walked away long before.

The cast on his arm, you see, was the product of a confrontation between the chief and a drunken lout who, following a public chastisement, attacked him with a club, breaking his arm in two places. That might have been enough to make a smaller person turn his back on his community.

I fear I am a smaller person than he.

One For All, or Free For All?

One for all and all for one? Policy-making processes aspire to this, but where IT is concerned, it’s as often a free-for-all as one-for-all.

One of the biggest problems we face when we try to establish standards and policies around technology is that it extends into all sectors of society and the economy. This often results in very different views about – well, about pretty much everything.

Some people see ICT policy-making as a chance to pave the way for new business opportunities. Some see it as a chance to enhance the same moral, ethical and legal framework that currently defines their society; others see it as an opportunity for social transformation. Still others see it as merely a vehicle to define technical standards and protocols. Yet others see ICT as only one little egg in a much larger policy basket.

Getting everyone to agree on the process of establishing a national ICT policy, therefore, can be an exercise akin to herding cats and chickens all at once. Priorities are like noses: everyone’s got one, and every one of them is different.

Nothing is Ever 'Good Enough'

There’s a long, rather drawn out thread on Slashdot right now, wherein an apparently endless queue of geeks are lined up to take Wired to task for their discovery that Good Enough trumps Excellence every time. Quelle Surprise.

But not one of them has observed something that was recently made obvious to me: As technology advances, quality inevitably improves. The world, pace Microsoft, is not so awash in the mediocrity that Wired’s editors have decided to tout as the next big thing. Nothing is ever Good Enough.

What matters more than anything else is Convenience.

My eyes were opened to this a couple of months ago, when, in the course of pillaging my landord’s extensive library of books of and about photography, I came across a truly startling collection of photos from Papua New Guinea taken in the early 1920s. The almost liquid tones and gorgeous, lush light in his portraits capture the smoky, dusky interiors of village huts better than anything I’d ever seen before.

When I voiced my admiration to Ben, he observed, “Photography hasn’t significantly improved since the early years. It’s just become more convenient.

Action and Reaction

For every action, there is an equal and opposite reaction.

When Isaac Newton first formulated his third law of motion, he codified a long-observed phenomenon. Wits have suggested a fourth law: ‘No good deed goes unpunished.

At the Lowy Institute’s recent conference, The Pacific Islands and the World, attendees witnessed two contrasting views of Vanuatu. The gathering, timed to coincide with the Pacific Forum, was attended by dignitaries from major global institutions as well as government leaders from throughout the region. It was billed as an opportunity to discuss the impact of the global economic crisis on vulnerable Pacific Island nations.

By all accounts, though, Vanuatu has been less affected than the global economic giants. Mid-year numbers do indicate a slight slow-down, but in real terms, our economy’s still growing fairly well. In a recently published briefing paper by the Pacific Institute of Public Policy, Nikunj Soni and the Australian National University’s professor Stephen Howes point to tourism and construction as the leading drivers of this growth.

But they are quick to note that the environment is as critical to this success as the actual business opportunities. One noteworthy chart clearly shows the rise in economic activity starting in 2003, about the same time as major budgetary and macro-economic reforms began to take hold in Vanuatu.

The briefing paper goes on to highlight the fact that none of this growth would have been possible without social stability. That may seem like so much common sense to some. Civil disturbance and political turmoil are seldom on a tourist’s must-see list. Likewise with home buyers.

But what brings this stability about?

Copyright and the Social Contract

[This week’s Communications column for the Vanuatu Independent. It’s a somewhat fleshed out and more rounded version of this essay.]

Since the arrival of the Internet, there’s been unceasing talk about the imminent demise of traditional publishing models (especially newspapers), the subversive effect of ‘free’ online content and the purported damage done by Peer to Peer ‘pirates’ sharing music, movies and other creative works. At the centre of all this debate over the imbalance that new technology has created between creator and consumer is the oft-ignored conclusion that copyright as a regime for encouraging creativity in modern society is simply unworkable on the Internet.

Pundits, lawyers and media distributors the world over continue fighting the tide, thinking they can shape the Internet to match their expectations concerning copyright. Instead, they should be shaping their expectations to match the Internet.

Creativity and the Social Contract

Tangled up amidst all the talk about the imminent demise of newspapers, the subversive effect of Free, the purported damage done by Peer to Peer ‘leeches’ and various other riffs on the imbalance that new technology has created between creator and consumer is the often unexamined conclusion that copyright as a regime for encouraging creativity in modern society is simply unworkable on the Internet.

That leaves us with two options: We can continue to tinker with copyright, attempting to redefine fair use, to place reasonable penalties (or at least disincentives) on unauthorised copying… ultimately, to renegotiate the compromise that lies at the heart of the concept.

That’s a commendable, fundamentally reasonable approach that unfortunately ignores the fact that digital information is immune to copyright enforcement. The practical ‘right’ to make copies is the very essence of digital technology. Its usefulness is predicated on the fact that data is infinitely mutable and that copies cost as close to nothing as makes no difference. To pretend that we can place anything more than voluntary limits on this capability is dangerously naive.

Alternatively, we can scrap copyright, go back to first principles and examine in detail what the rights of the creator really are.

Fibre Optics

Last weekend’s announcement by Minister Rialuth Serge Vohor of an agreement to participate in the SPIN fibre-optic project had been met with cautious optimism from observers. While nobody doubts the desirability of having an undersea cable linking Vanuatu to the rest of the world, some questions remain.
